Gay woman fired for 'masculine' appearance

The Gender Public Advocacy Coalition has expressed its support for Dawn Dawson, whose employment discrimination lawsuit against Bumble and Bumble, a New York City hair salon, was dismissed on Feb. 17 by the Second Circuit Court of Appeals.

Dawson brought her suit under Title VII of the Civil Rights Act of 1964, and under New York State Human Rights Law, claiming discrimination on the basis of sex, sex stereotyping, and/or sexual orientation.

Dawson, who is openly gay, stated in her suit that she was harassed for her masculine appearance, called "Donald," and told that she looked so unfeminine that she would scare away wealthy customers. In part, the Court held that Dawson's claims of sex stereotyping derived not from gender stereotypes, but from stereotypes about her sexual orientation.

Sexual orientation is not protected under Title VII.

"Employees should be judged on their merits of their work, and not whether they meet someone's standard for a real woman or real man," said GenderPAC's executive director, Riki Wilchins. "We hope Congress will move forward with national legislation that will ensure workplaces where every employee can contribute regardless of their sexual orientation or gender identity and expression."
